It should be pointed out that the border control operations are conducted in accordance with Community law,in particular with the Schengen Borders Code.

Member of the Commission.- Mr President,the Members have for their consideration a draft decision supplementing the Schengen Borders Code as regards the surveillance of the external borders in the context of FRONTEX operations at sea.
This means that the Schengen Borders Code will now be amended as proposed by the Commission under the comitology procedure, adding the annex, with non-binding measures on obligations during sea search and rescue operations, to the directive.
I therefore support the technical proposals introduced by the rapporteur, Mr Cashman,to take into account the specificity of the Schengen Borders Code since it constitutes a development of the Schengen acquis.
The motion for a resolution concerns the draft Council decision and supplements the Borders Code as regards the surveillance of the sea borders within the framework of operations coordinated by Frontex for measures to rescue people at sea.
This kind of action is compatible neither with the European Convention on Human Rights nor with Community law,particularly the Schengen Borders Code and the Repatriation Directive, nor with Italian law.
Among other things, adopted legal instruments such as the Schengen Borders Code, the External Borders Fund, the European Agency for the Management of Operational Cooperation at the External Borders of the Member States- FRONTEX for short.
I voted in favour of the motion for a resolution for reasons which go beyond the draft decision andthe content of the Council proposal on supplementing the Borders Code as regards the surveillance of the sea external borders. .
For example, as regards border controls, the provisions of Article 6 of the Schengen Borders Code require that border guards execute checks with no discrimination against travellers on grounds of racial or ethnic origin, religion or belief.
Rapporteur.- Madam President, this Commission proposal, on which I am Parliament's rapporteur, is the fourth element of the Visa Information System(VIS) package, coming after the VIS regulation, the VIS access decision andthe measure on the use of the VIS under the Schengen Borders Code.
In view of the expectations that Europe's citizens have when itcomes to internal security, I wholeheartedly support the amendments to be made to the Schengen Borders Code in order to guarantee the effective use of the Visa Information System(VIS) at our external borders.
The next item is the report by Mr Brejc, on behalf of the Committee on Civil Liberties, Justice and Home Affairs, on the proposal for a regulation of the European Parliament and of the Council amending Regulation(EC) No 562/2006 as regards the use of the Visa Information System(VIS)under the Schengen Borders Code- C6-0086/2008.
FR- On the basis of the report by my excellent Slovene fellow Member Mihael Brejc, I voted for the legislative resolution approving, at first reading under the codecision procedure, the proposal for a regulation of the European Parliament and of the Council amending Regulation(EC) No 562/2006 as regards the use of the Visa Information System(VIS)under the Schengen Borders Code.
Under important instruments proposed by the Commission- like the Schengen Border Code, Eurodac, SIS, VIS- the use of unjustified ethnic profiling techniques is not authorised.
The Schengen Information System, the Schengen visa,the Schengen Border Code and the Visa Code are all subject to the codecision procedure and, as we move towards ratification of the Lisbon Treaty and a more simplified and united legal structure throughout the European Union, we should be seeing greater involvement of Parliament in these issues, not less.
The Commission also supports the inclusion in the 2010 work programme of the agency of a project on implementing Article 6 of the Schengen Border Code that aims at collecting data.
On the legal aspects of the proposal,the Commission has chosen Article 12 of the Schengen Border Code as the legal basis because the rules concern border surveillance patrols during FRONTEX operations, not border checks as I think Parliament's legal opinion argues.
