Secondly, in the framework of the programme for simplifying legislation3 the Commission proposes consolidating and merging the Railway Interoperability Directives 96/48, 2001/16, 2004/50.
Annex I describes the principles laid down in the Interoperability Directives and the status of the TSI adoption process.
The Interoperability Directives require lists of national rules to be notified to the Commission, hence ensuring the necessary transparency of these rules;

The Railway Safety Directive requires checks to be carried out of safety andtechnical compatibility(i.e. two essential requirements of the six mentioned in the Interoperability Directives) when rolling stock is to be used on other networks.
This extension will entail amending Regulation(EC)No 881/2004 establishing the European Railway Agency(hereinafter referred to as the“Agency”), and the Interoperability Directives(96/48/EC, 2001/16/EC, 2004/50/EC) and the Railway Safety Directive 2004/49/EC.

It should be borne in mind that, according to the provisions of the draft interoperability directive, the Agency's responsibilities will eventually expand to include the entire Community rail network.
