(8) It is necessary to exclude from the scope of this Directive natural mineral waters and waters which are  medicinal products, since special rules for those types of water have been  established in Directive 2009/54/EC of the European Parliament and of the Council of 18 June 2009 on the exploitation and marketing of natural mineral waters9 and Directive 2001/83/EC of the European Parliament and of the Council of 6 November 2001 on the Community code relating to  medicinal products for human use10.
For the same reasons, he considered that it was necessary to exclude X from subsidiary protection under the second paragraph of Article 55/4 of that Law.
