As regards likelihood of confusion, the Court of First Instance first recalled the caselaw to the effect that such likelihood exists if the relevant public might believe that the products in question come from the same undertaking, or from economically-linked undertakings. .

(34) However, if the institution works on a cross-border basis, it may be asked by the competent authorities of the host Member State to apply limits for investment in shares and similar assets not admitted to trading on a regulated market, in shares andother instruments issued by the same undertaking or in assets denominated in non-matching currencies provided such rules also apply to institutions located in the host Member State.
(10) While this Directive is not addressing ownership issues it is recalled that in case of an undertaking performing transmission or distribution and which is separated in its legal form from those undertakings performing generation and/or supply activities,the designated system operators may be the same undertaking owning the infrastructure.
It therefore considers that there is a likelihood of confusion in Germany,in the sense that the public may think that the goods in question come from the same undertaking or, as the case may be, from economically linked undertakings. .
