Member States may exclude from the scope of the measures implementing this Directive.
In implementing this Directive, Member States should refrain from pursuing active recruitment in developing countries in sectors suffering from a lack of personnel.
Member States shall allocate the necessary resources in connection with the national law implementing this Directive.
While implementing this Directive, Member States should also be able to further specify the application of the rules of Regulation(EU) 2016/679, subject to the conditions set out therein.
It is important to avoid possible complications that could occur when Member States are implementing this directive.
Recommends that when implementing this directive, Member States take account of the Commission's recommendation on aggressive tax planning as well as the interpretation of the European Court of Justice.
The following systems are excluded Member States may exclude from the scope of the measures implementing this Directive: Am.
In implementing this Directive Member States should avoid imposing administrative, financial and legal constraints in a way which would hold back the creation and development of small and medium-sized undertakings.
Member States shall ensure that guidance and training are made available for those responsible for implementing this Directive.
In order to ensure that the requirements set out in this Directive or the measures implementing this Directive are applied in practice, any infringement of those requirements should be subject to penalties.
In line with theEuropean Convention on Human Rights, respect for family life should be a primary consideration of Member States when implementing this Directive.
Member States shall take appropriate measures to ensure that authorities andother organisations implementing this Directive have received the necessary basic training with respect to the needs of both male and female applicants.
Member States should ensure that competent authorities havethe power to impose sanctions or measures where provisions of national law implementing this Directive are not complied with.
By way of derogation from paragraph 1, Member States that encounter particular difficulties in implementing this Directive shall be able to benefit from an extension of a maximum of one year of the implementation period provided for in paragraph 1.
Member States shall ensure that competent authorities establish effective mechanisms to encourage reporting of breaches of the national provisions implementing this Directive to competent authorities.
Member States shall take appropriate measures in order toencourage the authorities responsible for implementing this Directive to cooperate with each other and provide each other and the Commission with information in order to assist the functioning of this Directive. .
Member States shall ensure that the competent authorities establish effective mechanisms to encourage reporting of breaches of national provisions implementing this Directive to the competent authorities.
Member States may exclude from the scope of the measures implementing this Directive:(a) privately owned railway infrastructure and vehicles exclusively used on such infrastructure where this exists solely for use by the owner for its own freight operations;
(26a) The social partners are best placed to find solutions that correspond to the needs of both employers and workers andshould therefore be given an important role in implementing this Directive.
Whereas five years after adoption of this Directive at the latest the Commission must review the detailed rules for implementing this Directive with a view to proposing, where appropriate, the necessary amendments.
In line with the European Convention for the Protectionof Human Rights and Fundamental Freedoms, respect for family life should be a primary consideration of Member States when implementing this Directive.
Wherever a river basin gives rise to transboundary impacts on bathing water quality,the Member States involved shall cooperate as appropriate in implementing this Directive, including through the appropriate exchange of information and joint action to control those impacts.
The Commission will use the information provided by the Member States, and existing information available under Union legislation, to keep the European Parliament andthe Council informed of progress made in implementing this Directive.
The Commission may assist the Member States in implementing this Directive in a consistent way by issuing and updating existing guidelines, particularly on recommended standard licences, datasets and charging for the re-use of documents, after consulting interested parties.
Provisions on the participation of employees in company bodies provided for by national legislation and/or practice, other than those implementing this Directive, shall not apply to the SCEs to which Articles 3 to 7 apply.
The Commission ð may ï should assist the Member States in implementing this Directive in a consistent way by issuing ð and updating existing ï guidelines, particularly on recommended standard licences, datasets and charging for the re-use of documents, after consulting interested parties.
Provisions on the participation of employees in company bodies provided for by national legislation and/or practice, other than those implementing this Directive, shall not apply to the SCEs to which Articles 3 to 7 apply.
When implementing this Directive in respect of confiscation of property the value of which corresponds to instrumentalities, the relevant provisions could be applicable where, in view of the particular circumstances of the case at hand, such a measure is proportionate, having regard in particular to the value of the instrumentalities concerned.
The Commission shall submit a progress report to the European Parliament and Council at the latest one year after the deadline for theestablishment of the maritime spatial plans and integrated coastal management strategies, outlining the progress made in implementing this Directive.
Member States shall ensure that competent authorities establish effective mechanisms to encourage reporting of breaches of the national provisions implementing this Directive to competent authorities and that the competent authorities provide one or more secure communication channels for persons to provide notification of such breaches.
