The Article also provides flexibility and simplification for cases in which there can be a derogation from the standard comitology procedures(e.g. no comitology used in case of technical adjustments orminor alterations of the overall allocations) and for cases where the comitology procedures could be applied after the adoption and implementation of Commission's amendments(e.g. cases of crisis, post-crisis and fragility or in the cases of threats to democracy and human rights).
(b) however, in the event of shortcomings by the OCT concerned, the Commission shall take action, if the OCT fails to remedy the situation and attempts at conciliation are unsuccessful,to reduce or withdraw the balance of the overall allocation corresponding to the financing decision of the Programming Document.
(6) The examination procedure referred in paragraph(1) shall not apply to non-substantial modifications to multiannual indicative programmes, making technical adjustments, reassigning funds within the indicative allocations per priority area or increasing ordecreasing the size of the initial overall allocation by less than 20%, provided that these modifications do not affect the priority areas and objectives set out in the multi-annual indicative programmes.
