ACFA will be invited to develop such a Code by the end of 2002.
The case for such a code has been set up by the Ombudsman, Jacob Söderman.
However, the Commission does not consider that its role should be to devise or impose such a code of conduct on business.

I am convinced that such a code of conduct will lead to us improving our administrative practices, and that we can improve relations between the Commission's services and the citizens.
There is a risk, however, which is also evident from theOmbudsman' s annual report, that the significance of such a code would vary considerably from one institution or body to another.
It appears likely that such a code will soon become a reality, as the European Commission has adopted the draft in its first reading before the Commissioners resigned.
The Commission for its part is prepared to support any initiative which will lead to such a code of conduct being established, and the White Paper is intended as a contribution to these efforts.
Whereas such a code can only be efficient if it is a publicly accessible document for the citizen, and thus published in the form of a decision like the abovementioned Decision on public access to Foundation documents.
Four non-governmental organizations(NGOs)- Oxfam, Amnesty International, Safeworld andthe British American Society Information Council- recently published a briefing document, outlining the essential standards which such a code of conduct should establish.
Such a code is beginning to be effective, not simply because the companies involved sign up to a proper declaration of principles, but because this is matched too by a practical system of monitoring and verification which guarantees that those principles are upheld.
Whereas, in its resolutions C4-0270/98 and C4-0138/99, the Parliament welcomed the initiative for a code of good administrative behaviour for the European institutions and bodies, andstressed the urgent need to draw up such a code as soon as possible;
We are not ill disposed towards a code of conduct with ethical clauses for companies that invest in, or trade with, developing countries,but we believe that such a code of conduct should be laid down within the framework of the WTO's and the World Bank's work and not be restricted only to companies within the EU.
Whereas such a code is useful for both staff members, as it will inform them in a detailed manner of the rules they have to follow when dealing with the public, and the citizen, as it will provide her/him with information on the standard of conduct they are entitled to expect in dealings with the Community administrations.
We Liberals therefore support the Commission in its approach andin its call for a code of conduct and we hope that such a code will really bring transparency, that the basic motives for the investment of these sovereign wealth funds become clear and that the funds themselves apply good corporate governance and stick to it.
In a resolution adopted on 6 September(5), Parliament, considering it essential that the same code of good administrative behaviour should apply to all European institutions, bodies and agencies,called on the Commission to submit an appropriate proposal for a regulation containing such a code, based on Article 308 of the EC Treaty.
I should like to emphasise that such a code must not be based on the punitive and suspensive nature of the human rights clause, but on mutual respect between the parties concerned, incorporating as many positive incentives as possible and including generous cooperation programmes, that will enable respect for human rights to be strengthened at all levels.
