The Bank and Payment service user conclude the Framework Contract in Serbian.
Duration and termination of the Framework Contract Article 25 The Framework Contract is concluded for an indefinite time period.
Interest is calculated on a monthly basis andaccrued to the account in accordance with the Framework Contract.
It is considered that the notification of the Framework Contract termination is sent as on the date of submitting the written notification.
The provisions of the General Terms of the Bank will apply toeverything else not agreed by these General Terms, and/or the Framework Contract.
The Bank may terminate the Framework Contract in other cases provided by the law governing contracts and torts and other laws.
The type and amount of al fees andactual costs the Bank charges the Client have been provided for in the Tariff of the Bank, which is an integral part of the Framework Contract.
The Framework Contract may also specify provision of all types of additional data, acknowledging the Bank's possibility to process and deliver data.
Each payment transactions for which the Payment service user has not given consent in the manner stated herein and/or in the Framework Contract, will be considered by the Bank as unapproved.
The Framework Contract may be terminated in a written form, by the mutual agreement between the Bank and the Payment service user or by unilateral termination.
All the notifications and information made available by the Bank to the Payment service user pursuant to the Framework Contract, will be presented by the Bank in all its business premises and on the Internet presentation.
In the event of termination of the Framework Contract by the Bank, the Bank has right to collect all fees for conducted payment services to the Payment service user provided until the termination date.
If provisions of these agreements are contrary to the provisions of General Terms, provisions of the General Terms will apply, that together with agreements andother documents stated herein comprise the Framework Contract.
The Bank may also terminate the Framework Contract in other cases prescribed by the law governing contracts and torts and other law.
The Client may authorize one ormore persons in writing in the manner prescribed by the General Terms and Conditions for the execution of payment transactions under the Framework contract and/or agreement on opening and maintaining certain types of payment accounts.
If the provisions of these contracts on current accounts are contrary to the provisions of the General Terms, the provisions of the General Terms that together with contracts on current accounts andother documents stated herein comprise the Framework Contract, will apply.
Termination of the Framework Contract Article 18 The Service user has the right to terminate the Framework Contract at any time during the validity period in a written form, subject to one month notice period.
The Payment service user has the right to have delivered, during the contractual relationship, at the request,a copy of the Framework Contract and/r the information determined as obligatory elements of the agreement, delivered in the pre-agreement phase in the paper or in the manner as prescribed hereby.
In the case of the Framework Contract termination by the Bank, the Bank has the right to collect all fees for executed payment services to the Payment service user up to the moment of the Framework Contract termination.
In the case specified in paragraph 3 hereof, the Bank is obliged to notify the Service user, at the same time when submitting the proposal from the same paragraph,of its right to terminate the Framework Contract with payment of no fee and other costs before the day of commencement of implementation of the proposed amendments and supplements, if they do not accept that proposal.
In the event of the cessation of validity of the Framework Contract, the Payment service user will be obliged to settle all their obligations to the Bank arising from the current account for which the Framework Contract ceases to be valid.
The applicable form of the request for opening current account is integral part of the Framework Contract and includes a list of necessary documents that the Payment service user must submit to the Bank for the conclusion of the Framework Contract. .
The Bank has right to terminate the Framework Contract concluded for an indefinite time period at any time during its validity subject to two months' notice period, that starts from the day the Bank sends a written notification to the Service user of the Framework Contract termination.
The Client agrees that the Bank may terminate the framework contract in all cases provided by the agreement on opening and maintenance of payment account, the agreement on a single additional service and the General terms and conditions.
If the Payment service user terminates the Framework Contract, the Payment service user will be obliged to pay to the Bank the fee for the payment services provided until the termination date, and if the fee is paid in advance the Bank will return to the Payment service user the proportionate amount of the paid fees.
If the Payment service user terminates the Framework Contract, the Payment service user will be obliged to pay the fee only for the payment services provided up to the date of termination, and if such fee has been paid in advance, the Bank is obliged to refund the Payment service user with the relative amount of the paid fee.
During the validity of the Framework Contract, the Service user has the right to request a copy of its contract and the General Terms and Conditions relating to the card usage, as well as the information on obligatory contract elements submitted in the pre-agreement phase, in the paper form or on another durable media.
The Payment service user agrees that the Bank may terminate the Framework Contract and/or the agreement on opening and maintenance of a transaction account or additional services regarding the payment account and due to non-realisation of rights and inactive operations under agreement(s) by the Payment service user, if the period of non-realisation of rights is longer than 365 days.
Before concluding the Framework Contract, the Bank will submit to the Payment service user the documents which are integral part of the Framework Contract(Framework Contract draft) and in that way enable the Payment service user to establish, in the pre-agreement phase, conditions for opening, maintenance and termination of current account and provision of payment services under that account.
