Reference quantities to be applied are listed in Annex I.
(c) centralise andsupervise transfers of reference quantities without land;
Reference quantities for deliveries and those for direct sales shall be recorded separately.
It shall apply for each producer only to the reference quantities available to that producer on 31 March 2000.
Reference quantities not, or no longer, allocated to individuals shall be included in the national reserve referred to in Article 5 of Regulation(EEC) No 3950/92.
(b) Member States may decide not to apply the provisions on transfer of reference quantities in Article 7(1).".
Transfers of reference quantities together with land.
Special provisions are needed to cover cases where the reference quantity for deliveries is amended or where reference quantities are allocated from the national reserve.
Where a producer has two reference quantities, his contribution to any levy due shall be calculated separately for each one.
(a) grant compensation in one or more annual instalments to producers who undertake to abandon definitively all orpart of their milk production and place the reference quantities thus released in the national reserve.
Some of the applicants were granted provisional special reference quantities, while others were granted definitive special reference quantities.
The reference quantities may be allocated provisionally for the eighth period of 12 months, provided that the amount thus allocated is not modified during the said period.
Member States should also be entitled to organise the transfer of reference quantities in other ways than through individual transactions between producers.
Where additional reference quantities are allocated from the national reserve, the reference fat content referred to in Article 9 of Regulation(EC) No 1788/2003 shall remain unchanged.
However, if a part reverted to the national reserve on the occasion of a transfer of reference quantities the reduction shall not apply to cases where reference quantities are transferred back.
Specific reference quantities provisionally allocated under this Regulation may not be included in any milk production abandonment programme for three years following provisional allocation of that quantity. .
The competitivity gap shall be calculated on the basis of the reference quantities and the difference between the third country reference price and the ACP reference price.
Before a date that they shall determine and by 31 March at the latest, Member States shall authorise, for the 12-month period concerned,temporary transfers of individual reference quantities which producers who are entitled thereto do not intend to use.".
This allocation should be based on the reference quantities held by producers for the twelve-month period commencing on 1 April 2003.
(3) Annex A(b) of Regulation(EC) No 2851/2000 lays down the quantities of certain agricultural products that may be imported from Poland with a total exemption or reduction of customs duty subject to tariff quotas,ceilings or reference quantities from 1 January 2001.
The Member State may require producers with reference quantities for direct sales to declare that they have not sold any milk during the period concerned, where such is the case.
In the cases referred to in the first subparagraph of paragraph 2 and in paragraphs 3 and 4, the resulting reference fat content shall be equal to the average of the initial and transferred or converted reference rates, weighted by the initial andtransferred or converted reference quantities.
(16) The temporary transfer of parts of individual reference quantities in Member States which have authorised this has proved to enhance the effectiveness of the scheme.
Where the national reference quantity for direct sales has also been overrun, producers who have overrun their reference quantity shall also be liable to the levy on the full excess quantity andmay not benefit from any reallocation of unused reference quantities as provided for in the second subparagraph of Article 2(1) of Regulation(EEC) No 3950/92.
That content shall be altered during the conversion referred to in Article 6(2) and where reference quantities are acquired or transferred, under the rules to be laid down in accordance with the procedure referred to in Article 23(2).
However, unused reference quantities shall not revert to the national reserve in case of force majeure and in duly justified cases affecting the production capacity of the producers concerned and recognised by the competent authority;
(5) The reference period to be used for defining categories of operators and determining the reference quantities of traditional operators should be the three-year period 1994 to 1996.
After the grant of the abovementioned special reference quantities, the Netherlands authorities carried out checks in order toascertain whether the applicants were producing the reference quantities under the terms laid down in the Community rules.
The Committee may examine any question concerning the application of tariff quotas,tariff ceilings and reference quantities, which is raised by its chairman either at the latter's initiative or at the request of a Member State.
Without prejudice to Article 6(1), reference quantities available to producers who have not marketed milk or other milk products for one of the 12-month periods shall be allocated to the national reserve and may be reallocated in accordance with the first subparagraph.
